Driving School Terms & Conditions

Subject to Terms and Conditions: 

We advise all clients to speak with us by email or telephone communication 'before' making an online payment.

  We reserve the right to amend driving lessons if we are unable to keep the appointment in the event of pre-booked driving tests, mechanical breakdown, sickness, pre-booked holidays or due to immovable traffic.

 

Your First Lesson Must be Paid in Advance to the Wilson's Driving School to Avoid Last Minute Cancellations.

 Lessons will be conveyed verbally in detail before making any lesson booking.

Online payments for gift vouchers expire after 6 months but can be extended if requested within the time limit. 

​

We work as a franchisee of Wilsons Driving School  if you have not received a response from us, or if for any reason we have not been unable to make contact with you within 5 working days of making your online payment.

We will help book Theory and  practical Driving Tests, an ADI reference number will be supplied to confirm the readiness of the student drivers ability for test and for use of the Wilson's Driving School vehicles. 

​

We Reserve the Right to Refuse Students to Test in Our Vehicles if we do not feel the Student is Test Ready, All Students will have the Opportunity to have a Mock Test with another one of Our Driving Instructors to Check their Standard is Test Ready and to help the Student with the Test environment.

Introduction

​

Welcome to Wilson's Driving School & Automatic school of Driving Terms and conditions of use (these Term’s). We want you to know yours and our rights before you use the book driving lessons either by phone, website or application (book driving lessons App). Please take a few minutes to read these terms before enjoying the website or application, because once you book and pay for lessons you are going to be legally bound by these terms (so probably best to read them first).

 

Wilsons Driving School Instructor Franchise

 

Wilsons Driving School acts as an agent for its franchised instructors. We take bookings on behalf of our instructors. It’s their responsibility to arrange all further bookings with the client.

Wilsons Driving School acts as agent for your instructor in receiving your payments for driving tuition other than payments made directly by you to your instructor

​

The terms & conditions of business under which driving instruction is provided are outlined below.

​

These terms & conditions of business are a contract between the client and the driving instructor & The Driving School.

​

Any alterations to these terms & conditions of business will always be notified to the client in writing, in advance of the change.

​

These terms and conditions shall be construed under the laws and subject to the sole jurisdiction of the courts of England & Wales.

​

These terms and conditions of business do not affect your statutory Rights.

​

Code of Conduct

​

The driving instructor and The Driving School abide by a Professional Code of Conduct, copies of which are available on Request.

​

Documentation

​

Before or on the first driving lesson, the client will be supplied with a copy of the ‘Terms & Conditions of Business’ of The Driving School, details of tuition fees, contact details of The Driving School and their Instructor.

​

The client will be asked to sign a copy of the ‘Terms & Conditions of Business’ to state that they have read and agree to be bound by them, either before or at the start of their first driving lesson.

​

Entitlement to Drive

​

Tuition is only available to persons who meet the following criteria.

​

Aged 17 or over or aged 16 or over and in receipt of the higher rate of Disability Living Allowance (mobility component)

​

The client must hold a current, valid driving licence that entitles them to drive in the UK.

​

The client must satisfy the requirements of medical fitness to drive, including being able to read a number plate at the prescribed distance.

​

The driving licence must be produced at the client’s first driving lesson, and it will also be checked periodically by the driving instructor.

​

Any points, endorsements, bans, convictions, or restrictions of any kind on your licence must be notified to your driving instructor or The Driving School immediately.

​

Any medical condition or disability that might affect your ability or entitlement to drive must be notified to The Driving School Immediately.

​

Fitness to Drive

​

It is the client’s responsibility to ensure that they are fit to drive.

​

The client must inform their driving instructor or The Driving School as soon as possible of any medical condition, disability or injury that may affect their ability or entitlement to drive.

 

The client must inform their driving instructor if they feel unwell before or during a lesson.

 

The client must ensure that they do not drive whilst under the influence of alcohol, or drugs (some prescription and ‘over the counter’ medicines can cause drowsiness).

 

The client should ensure that they do not arrange driving lessons at times when they are likely to be tired, stressed, or otherwise distracted.

 

The client must wear suitable footwear, and clothing that does not restrict movement, or impede their ability to drive safely in any way.

 

Where spectacles or contact lenses are required in order to meet the eyesight requirement for driving, they must be worn at all times while the client is driving.

 

Behavior

 

The driving instructor & The Driving School will not tolerate any form of verbal or physical abuse, whether directed at the driving instructor, a driving examiner, or any other road user.

 

The driving instructor reserves the right to terminate any lesson at any stage should in their sole opinion they feel that it is inappropriate to continue because of the client’s behaviour, sobriety or state of mind.

 

In these circumstances the lesson fee is forfeit, and it is at the instructor’s sole discretion as to whether further transport is provided.

 

The instructor or The Driving School is not liable for any cost of transport procured by the client or arising thereof.

 

 

 

Driving Instructor lesson reservation fees:

​

To book a driving lesson with your driving instructor will require a £15 deposit to reserve a gap.

​

You can then either pay the balance of the lesson on the day, or ask your driving instructor to hold the £15 reservation fee against future lesson bookings.

​

You can ask for your £15 reservation fee back at any time, or use it as a credit against a lesson (see cancellation fees below).

​

You don’t have to pay the £15 reservation fee, but your driving instructor may choose not to hold a future lesson date for you. As an alternative you may be offered a choice of spaces that haven’t been reserved by payment.

​

We decided to take this action because some customers book lessons and then either cancel them or do not turn up for the lesson.

​

Doing so then stops other people from booking their lessons, and the driving instructor doesn’t get paid for their lost time.

​

99% of driving instructors in the UK are self-employed, that also includes the instructors who work for driving schools on a franchise.

​

Driving instructors get paid by the customer and not the driving school, meaning if gaps are empty the instructor isn’t earning.

​

The instructors expenses go towards paying the driving school for using their brand and services, the tuition vehicle, maintenance, tyres, insurance, and fuel plus other expenses.

​

Therefore cancellations have a huge effect on an instructor’s income.

​

Customers expect on-going driving lessons each week, therefore driving instructors have to reserve gaps for them every week. This means they can only offer a service to a limited number of customers at any given time.

​

When a customer cancels a lesson, the instructor can only offer that space to an existing customer, and unfortunately most gaps don’t get filled leaving the instructor out of pocket.

​

FAST TRACK COURSES

BY CLICKING 'BUY NOW' BUTTON YOU AGREE TO ACCEPT OUT TERMS & CONDITIONS

Customers wanting to book an intensive driving course of will be asked to pay a deposit of Specified on the Fast Track Course to reserve the course date and for the driving school to book a driving test date at Students expense or students can book there own once our Driving Instructor have Accurately assessed the student for a minimum of 2hours Driving, The Driving instructor has the power to change the Course Selected if the one Selected is not Suitable for the Student after assessment. The Driving Instructor has the right to cancel ,decline and refuse Practical Driving Test Dates if he or she feels the Student is not Ready or in Right state of mind for Practical Driving Test, We will ask for the course deposit payment on Booking the Fast Track courses  Online then you must pay remaining Balance Direct to Driving Instructor on start date. Please note Deposits can not be Refunded as the Instructors will have to clear diary for the Intensive or semi intensive courses Prior to Start date ,if you need to Change or Postpone the Course you can do so at a 20% cost of the Course or if the Driving Instructor feels its a Valid Reason to change or postpone 

​

This will be treated as an affirmed booking, and if any of the time booked is cancelled less than 15 days before the first day of the course, the fee will be forfeit.

​

Payments:

​

Payments may be made by cash, bank transfer, credit, or debit card or through Klarna , Laybuy or Wilsons Driving School Website

​

(You will be advised whether The Driving School or Instructor has the facility to accept payment by credit or debit card)

​

Where a client falls into arrears with payments, The Driving School or Instructor reserves the right to discontinue tuition until such time as the client’s account is brought up to date, this may include withholding the use of the driving school car for a driving test.

 

Cancellation fees:

 

When you book a driving lesson you are agreeing to reserve a driving instructor’s time. If you cancel the lesson within 5 days you will lose your £15 reservation fee.

​

The £15 reservation fee ensures the instructor earns at least the minimum national wage for the time they reserved for the customer.

​

As an incentive the instructor will offer the cancelled space to an existing customer at a £15 discounted rate with the hope of filling that space.

​

If you cancel your lesson on the actual day of the lesson, the instructor cannot offer that space out to anyone else and they may charge you the full lesson price (this is at the instructor’s own discretion).

​

To cancel a driving lesson please text your driving instructor. Text is date stamped so you and your instructor have a record of when you cancelled the lesson.

​

Please do not call the instructor or the office to cancel your driving lesson.

​

Please don’t use email, messenger or any other system to cancel lessons because they are not monitored, and your cancellation will go missed meaning you will  be charged the full lesson fee if the instructor turns up for your lesson.

​

Lesson Fees

​

Before or on the first driving lesson, the client will be supplied with details of tuition fees.

​

Any alteration of tuition fees will always be notified in advance, and a copy of the new fees supplied as soon as practicable.

​

Price Changes

​

The cost of prepaid tuition is based on the lesson price in force at the time of booking and with the exception of the circumstances set out below, will be honoured for 12 months thereafter irrespective of any price increase that may occur between the date of booking and when the lessons are taken. Any unused lessons remaining after 12 months have elapsed shall have any lesson price increase applied prior to the lessons which shall become payable by you.

​

Circumstances where, if you have prepaid you will be either required to pay an additional amount beyond the cost of your prepaid lessons or receive a partial refund of some of your prepayments (as applicable).

​

Where you have moved postcode area and requested reallocation to another instructor because your current instructor does not operate in the new postcode area, you will be required to cover any difference in the hourly rate between those instructors where your new instructor charges a higher hourly rate or where your instructor charges a lower rate, you will be refunded the difference.

​

Where you have requested to switch instructors within the same postcode area and your new instructor charges a higher hourly rate than your previous instructor. You will be required to pay the difference in the hourly rate or where your instructor charges a lower rate, and receive a refund of the difference.

​

Where you have requested to switch instructors in the same postcode area and your new instructor charges a supplement (for example an additional fee for tuition in a car with automatic transmission), you will be required to pay any such supplement.

​

Where you have not undertaken any lessons for a period of three months and have been reallocated an instructor after a price rise in tuition has taken place. You will be required to pay the difference in price for your remaining lessons.

​

Change of Driving Instructor

​

It is the aim of The Driving School to have one driving instructor conduct all of your tuition in order to aid continuity, however it might sometimes be necessary that a change of driving instructor occurs, in these circumstances the client shall have the right to decline

​

lessons from the replacement driving instructor.

​

The Driving School will not be responsible for any losses (e.g. test fees) if the client chooses to decline lessons from the replacement driving instructor.

​

Change of Tuition Vehicle

​

Tuition vehicles are periodically changed, either permanently, or when a vehicle is temporarily off the road, due to mechanical or other problems.

​

When it is necessary to use a replacement vehicle for a driving test, every effort will be made to give the client as much notice as possible, in order that time can be arranged for familiarisation with the new vehicle, however, in the case of replacement due to mechanical problems this may not always be possible.

​

The Driving School will not be responsible for any losses (e.g. test fees) if the client chooses to decline lessons in the replacement vehicle.

​

Cancellations & Postponement of Lessons by The Driving Instructor

​

The Instructor May Cancel or Change the Lesson With Short Notice. Lessons might sometimes need to be postponed at short notice due to illness, mechanical breakdown or some other emergency or unforeseen occurrence, a mutually agreeable alternative appointment will be made.

​

Every effort will be made to notify the client of the postponement as soon as practicable, however in some circumstances it may be difficult to notify the client in advance of their appointment time.

​

In all other circumstances The Driving instructor will endeavour to keep all appointments, however when it is necessary to alter an appointment a the Client must give 24 Hours Notice , The Instructor May Cancel or Change the Lesson With Short Notice.

​

Appointment Times

​

The client should keep a record of appointment dates and times in order to avoid missed appointments.

​

The driving instructor will wait 15 minutes after the appointment time before deeming the lesson to have been cancelled with insufficient notice and will be Charged in Full.

​

The driving instructor will make every effort to be punctual, however traffic conditions may sometimes make this difficult, so the client should allow a 15 minute waiting period, should the driving instructor arrive late, the lesson will start from the time the instructor arrives.

​

If the instructor cannot complete the full lesson time, then this will either be added as a credit for the next lesson, or the amount of time lost by the client will be refunded by the instructor.

​

Driving Tests

​

Driving Tests should not be booked without first ascertaining the availability of your driving instructor and car, and agreement being reached with your driving instructor as to your readiness for the driving test.

​

Clients should notify their driving instructor of the time, date and location of their driving test as soon as practicable, and the appointment letter must be shown to your driving instructor for verification on the next driving lesson.

​

No responsibility will be taken by The Driving School or instructor for incorrect bookings unless the driving test appointment letter is produced.

​

No responsibility will be taken by the driving school for driving tests booked at times when the driving instructor is unavailable.

​

Clients will only be allowed the use of the driving school tuition vehicle for a driving test if the driving instructor agrees that the client is at test standard.

​

In the interests of road safety The Driving Instructor reserves the right to withdraw the use of tuition vehicles for the driving test, when in the driving instructor’s opinion the client is not at test standard.

​

Where the use of the driving instructor’s tuition vehicle is withheld for a driving test, the driving instructor will where possible give the client sufficient notice to enable them to cancel the test without loss of the test fee, this may not always be possible when the course of tuition is of an intensive nature.

​

No responsibility will be taken by The Driving School or driving instructor for withdrawing the use of the tuition vehicle for the driving test when, in their sole discretion, the driving instructor assesses the client as not being ready for the test.

​

Cancelled Driving Tests

​

When a driving test is cancelled due to mechanical failure of the driving school tuition vehicle, illness of the driving instructor or any other reason that is the responsibility of The Driving instructor, the client will be entitled to the cost of their next driving test fee to be paid for by The Driving Instructor, this is irrespective of whether the client continues to have driving lessons with The Driving Instructor.

​

The next driving test fee will not be paid for by The Driving Instructor if the client is given sufficient notice to cancel their driving test appointment without loss of the test fee.

​

The Driving Instructor will not be responsible for any additional tuition fees incurred whilst waiting for the next driving test appointment.

Wilson's Driving School or instructor have no control over driving tests cancelled by DVSA.

​

When a driving test is cancelled because the clients documents are not in order, the full fees due to The Driving Instructor for driving lessons and the use of the tuition vehicle for the driving test are still payable in full, unless cancelled in accordance with the normal period of notice.

​

Refunds

​

You are entitled to cancel your prepaid tuition at any time (for the provisions relating to the cancellation of individual lessons please see the “Cancellation of Lessons” If you have not taken any lesson(s) at the time of cancellation you will be entitled to a full refund of any amount paid to Wilson's Driving School, subject to the 48 hours’ cancellation notice and to the terms below (not applicable to intensive driving courses).

​

If you have taken lesson(s) at the time of cancellation. You will not be eligible for a refund on any lessons taken.

​

Where it is possible to do so, we will refund you using the same method you used to pay for your lessons when you made the payment. If for any reason we are unable to do this, we reserve the right to refund you by any other method we deem appropriate.

​

We may request additional information from you to confirm your identity in order to comply with the Money Laundering Regulations 2007; we will also use this information to ensure adherence to our Merchant Operating Instruction for card collection facilities.

​

Refunds may take up to 10 working days to reach you or your account.

​

Refunds for “Try Us” Offers will be made pro rata on any lessons not taken.

​

In the event of a “Buy one get one free” offer, no refund will take place once the first lesson has been taken.

​

Refunds on block bookings must be used or on going training at regular intervals to keep valid ,any unused training time will be recalculated at standard lesson fee rate if client has passed there practical driving test with us or if there is lack of communication by student or cancellation of block bookings, or Inactivities on students will be charged at the £70 per lesson rate and the remainder refunded accordingly. This is due to the Instructor time and Preparation used to plan jobs around the students needs. Block Bookings laid dormant for more then 4 months will be deemed null and void and any money not used will therefor be forfeited and no Refunds will be Given.

​

Refunds on Gift Cards have no money value and will be given in time (driving lessons) by the Driving Instructor , the Instructor has the right to decline ,refuse or change and cancel lessons , Gift cards must be booked within 24 months of purchase with one of our Driving Instructors at Wilsons Driving School . Gift Cards will be Valid for 5 years if Students keeps with Regular Lessons, schedule, or pre booked driving lessons if there is lack of communication by student (s) or cancellation of lessons or Inactivities on student(s) account or laid dormant for more than 6 months will be charged at the £100 per lesson rate for the booked lessons and remaining credit will be subject to a cancellation fee of lost earning by driving instructor,

Refunds on Fast Track Courses are non refundable , and time is given by the designated Driving Instructor for lessons, the Instructor has the right to decline ,refuse or change and cancel lessons, Tests are not a Guaranteed its down to the individual on the day, If you are taken for Fast Track this does not Guarantee you can sit test in the Driving Instructors Car , you may be refused by Driving Instructor if you are not at Practical test standard, Fast Track Courses are to advance the student (s) at a Faster rate then standard driving lessons , on average a student (s) need a minimum of 30 hours to get to a Practical Test Standard, our Fast Track Courses will help you gain experience quicker and so we charge a premium rate to do this. Students wanting to learn Fast Track must take a 2 hour assessment drive charged at £80 to get driving instructors recommended and estimated Fast Track Course Guidance.

Refund Procedure:

​

Contact your instructor within 24 hours of your lesson to explain your concerns over the service or the tuition that you received. He/she will calculate the refund with you.

 

If you are not satisfied with the outcome of the conversation with your driving instructor then contact Wilsons Driving School Complaints department by email to info@wilsonsdrivingschool.com

​

Give the name of your driving instructor along with the lesson time and date.

​

Explain the full details as to why you were not satisfied with either the service or the tuition you received.

​

*Refunds do not apply to cancelled lessons or to lessons on test day.

​

Our entire business is built on reputation and happy customers and your feedback will be used to improve our service and tuition going forward.

​

Transferability of Lessons

​

You cannot sell or transfer lessons which have been purchased in your name to any other person.

​

Supervision

​

For the purposes of assessing, maintaining and improving standards, it may occasionally be necessary for another driving instructor or driving examiner to observe a driving instructor giving tuition.

​

The client may expect an observer to be present on any of their lessons, notice of this would usually be given in advance of the lesson, however this might not always be possible.

​

Driving Examiners are periodically supervised conducting driving tests, therefore the client might be accompanied on their driving test by a supervising examiner, this is a legal requirement.

​

Client’s Property

​

The client is responsible for the care of any property they have with them when attending a driving lesson, and should ensure they do not leave anything behind.

​

The driving instructor and Wilson's Driving School will take no responsibility for any loss of or damage to any property belonging to, or in the possession of the client.

​

Legal Liability

​

The client, in accordance with road traffic law, is legally responsible for any traffic offences that occur whilst they are in charge of the vehicle.

​

The driving instructor will endeavour to train the client to the highest possible standard, however they can not be held responsible for the standard of driving or any errors that are committed whilst they are not giving tuition, either before or after the client passes a driving Test.

​

Complaints

​

If the client is not happy with any aspect of tuition, or of the standard of service offered, they should either raise the matter with their driving instructor, or if they prefer with The Driving School, with the minimum delay, and not later than seven days from the date of the cause of the complaint.

​

Every effort will be made by the driving instructor / driving school to resolve any complaint or issue.

​

Collection and Use of Data

​

Any personal data you provide will be held securely and in accordance with the Data Protection Act 1998.

​

We will use your personal data for the purpose(s) for which you have provided it. It may also be used for marketing, research and statistical purposes and crime prevention.

​

We may however need to disclose personal data to a third party so that the service you requested could be provided. It may also be necessary to transfer it to countries outside the European Economic Area. Where this happens, we will endeavour to ensure that any recipient of your data will treat it with the same level of protection as we would.

​

Your data may be disclosed to regulatory bodies for the purposes of monitoring and/or enforcing compliance with any regulatory rules/codes.

​

If you give us information about another person, in doing so you confirm that they have given you permission to provide it to us to be able to process their personal data (including any sensitive personal data) and also that you have told them who we are and what we will use their data for, as set out in this notice.

​

By providing us with your personal data and contact details, you consent to allowing Wilson's Driving School to contact you by post, telephone, email, SMS or other electronic means to inform you about products and services which it considers may be of interest to you.

 

Your calls to the Customer Service Centre may be recorded for quality monitoring and training purposes.
